System > Configuration > Sales > OneStepCheckout > Terms & Conditions : Positioning of Magento Checkout Terms and Conditions (on top of the checkout page)

and fill the following with required texts

System > Configuration > Sales > OneStepCheckout: Text block before order button (HTML)
